The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 324, 307, 447, 504 of the Indian Penal Code.

The prosecution case in short is that in the backdrop of previous dispute, the accused persons having variously armed, came at the house of informant and started abusing him. While the family members came to rescue him, they were also assaulted.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 23-05-2019. Charge sheet has

Patna High Court CR. MISC. No. 45904 of 2019(2) dt.24-07-2019 2/2 already been submitted. The nature of injury is said to be simple. No offence u/S 307 of the Indian Penal Code is made out. There is case and counter case between the parties. The injury on the side of the accused has not been explained by the prosecution.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-14, Saran at Chapra in connection with Garkha P.S. Case No. 286 of 2019.
