The petitioner seeks bail in a case registered for the offences punishable under sections 302, 379, 120-B of the Indian Penal Code and section 27 of the Arms Act. It is alleged in the F.I.R. that while the informant was at his home, he heard hull that his brother Radhanandan @ Mantu was killed at village Khajuri Chouraha. It is further alleged that the accused persons had demanded ransom of Rs. Five lacs from the informant's brother and they also took away the motor cycle of his brother.
It has been submitted on behalf of the petitioner that he is in custody since 22.07.2014. Charge-sheet has been
Patna High Court Cr.Misc. No.39307 of 2015 (3) dt.09-10-2015 submitted in the case. Petitioner has got no criminal antecedent. There is no allegation of tampering with the evidence against the petitioner. There is no eye witness to the occurrence. Except for the confession, there is no other material to suggest regarding implication of the petitioner in the present case. There is no circumstantial evidence even to suggest involvement of the petitioner. Other co-accused persons have been granted bail vide annexures 2, 3, 4 and 5.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IV, Danapur in connection with Sessions Trial No. 381 of 2015 arising out of Naubatpur P.S. Case No. 314 of 2014.
