The present application has been filed for transfer of Matrimonial Case bearing No.125 of 2020 from the Court of learned Principal Judge, Family Court, Muzaffarpur to the Court of learned Principal Judge, Family Court, Sitamarhi. Learned counsel for the petitioner submits that the marriage of the petitioner was solemnized on 01-02-2008 as per Hindu Rites and Customs at her parental house situated at district Sitamarhi after performing all ceremonies, given sufficient gifts and presentations as per the capacity of her parents.

After marriage petitioner went to her matrimonial home with her husband Naresh Kumar and began to lead a happy conjugal life. Out of their wedlock, two children were born, first child born on 05.11.2008 namely Arnav Kumar and

It is further submitted that after the death of the mother and father, Naresh Kumar became a man without guardian and as a result of which he started doing all the action according to his desire and odds.

Petitioner several times requested to her husband to look after the petitioner and both children but he always replied that he will do according to his choice and if she will make protest then she will have to face dire consequences. It is also a fact that the husband of the petitioner has fallen into bad company and despite several requests by the petitioner, he did not leave the bad company and rather he used to beat the petitioner by using filthy language and also threatened her to murder her and her two minor children. It has also been submitted by the learned counsel for the petitioner that she has no source of income and that being a single women, without any support, it would be difficult for her to regularly attend the proceeding at Muzaffarpur from Sitamarhi.

Accordingly, Matrimonial Case bearing No. 125 of 2020 is transferred from the Court of learned Principal Judge, Family Court, Muzaffarpur to the Court of learned Principal

Patna High Court MJC No.359 of 2021(4) dt.23-09-2022 3/3 Judge, Family Court, Sitamarhi.

The records of Matrimonial Case bearing No.125 of 2020 should be immediately sent by the Court of learned Principal Judge, Family Court, Muzaffarpur to the Court of learned Principal Judge, Family Court, Sitamarhi.
