JUSTICE PRABHAT KUMAR JHA ORAL ORDER 26-08-2015 Heard the learned counsel for the petitioners, the learned counsel for the informant and the learned Additional Public Prosecutor.
The petitioners seek bail in a case under Section 420, 466, 468, 471 and other sections of the Indian Penal Code. The gist of the allegation is that both the petitioners got a fraudulent order in a survey case from R. P. Srivastava, who retired in the year 2008. The petitioners also brought the fraudulent order and filed in court that the land stands in their names.
The learned counsel for the informant submits that
Patna High Court Cr.Misc. No.38102 of 2015 (2) dt.26-08-2015 2/2 enquiry was held and it was found that R. P. Srivastava has passed so many orders in such fashion after his superannuation. The case relates to opening of Jamabandi Khatiyan in the name of the petitioners and the same does not create any title. If it is found that R. P. Srivastava has done illegal acts, even after his superannuation, it does not affect the title of the title-holder. Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in Saharsa Sadar P.S. Case No. 21/2014. (Prabhat Kumar Jha, J) BKS/- U T
