The petitioner, in the present case, is seeking regular bail in connection with Bakhtiyarpur (Balwahat O.P.) P.S. Case No.117 of 2017, registered for offences alleged under Sections 147, 148, 149, 341, 323, 379, 307, 354, 504 and 506 of the Indian Penal Code and later on Section 302 of the Indian Penal Code was also added.

Learned counsel for the petitioner has pointed out that from the First Information Report specific allegation of assault which caused death of Ram Rekh Rai is attributed to the co-accused Bino Rai. There are general and omnibus allegations of assault against all the other accused persons by lathi and danda.

Patna High Court Cr.Misc. No.4734 of 2018 (2) dt.01-02-2018 Allegation against this petitioner is that he had assaulted the younger brother's wife of the informant.

It is further submitted that the prosecution and the accused party are co-villagers and in similar facts and circumstances accused Amresh Ray @ Amaresh Roy and Kirindeo Roy as also the Pintu Roy have been granted regular bail by different coordinate Benches of this Court.

Learned counsel for the State is present.

Considering the facts and circumstances particularly that there is no specific allegation of giving fatal against this petitioner, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa in connection with Bakhtiyarpur (Balwahat O.P.) P.S. Case No.117 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
