JUSTICE ARUN KUMAR ORAL ORDER 29-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 9.3.2018, seeks bail in Aurangabad (Town) PS Case No. 229 of 2014 registered under Sections .. of the IPC.

The allegation in brief is that Ankit Kumar Gupta and Vishal used to outrage modesty of the prosecutrix and also committed rape as revealed during investigation.

Learned Counsel for the petitioner submits that both the boys have been convicted by the Juvenile Justice Board and enquiry is complete against these two juvenile, the petitioner is father of one of the FIR named accused Ankit Kumar Gupta, there is no allegation against the petitioner, moreover the police did not find his involvement and therefore not sent up him for trial but cognizance has been taken against him.

Having considered the said facts and circumstances, the petitioner, namely, Anup Kumar @ Nepali Gupta is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge Ist -cum- Special Judge (Pocso) Aurangabad in connection with Aurangabad (Town) PS Case No. 229 of 2014.
