The petitioner herein is accused in Barun P.S. Case No. 40 of 2016, registered for offences punishable under Sections 379 and 411 of the Indian Penal Code read with Rule 40 of the Bihar Minor & Mineral Act, 1972. Pursuant to the notice issued to the petitioner, the petitioner appeared in connection with the above mentioned case before the Investigating Officer, his statement has been recorded and he was released on bond.

In view of the above, the petitioner has alternative remedy to apply for regular bail in the Court of learned Chief Judicial Magistrate, Aurangabad, in connection with the case aforementioned and if such an application is made, the learned trial Court shall dispose of the same in accordance with law bearing in mind that the accused-petitioner is not alleged to have

Patna High Court Cr. WJC No.672 of 2016 (2) dt.28-07-2016 2/2 violated the conditions of bond and there is no allegation that he has interfered with the investigation of the case. There is, therefore, no legal impediment, on the part of the learned Court below, to release the accused-petitioner if the learned Court below is satisfied that the accused-petitioner will be available for investigation and/or trial.
