ANJANA MISHRA ORAL ORDER 08-03-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 01.12.2017 in connection with Kuchaikot P.S. Case No.330 of 2017 registered for the offence under Sections 363 and 366(a) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is totally stranger to the family of the accused Pawan Kumar Ram and has no concern with the occurrence. His name has come only on the basis of suspicion and the victim's statement also does not include the petitioner's name. On the earlier occasion, this Court had called for a photo copy of the statement of the victim recorded under

Patna High Court Cr.Misc. No.8719 of 2018 (3) dt.08-03-2018 2/2 Section 164 Cr.P.C. from the court of ACJM-7th , Gopalganj, which has been received. The said report clearly indicates that the petitioner had no role to play as he has not been named by the victim girl in her statement under Section 164 Cr.P.C. Considering the entire facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-7th, Gopalganj, in connection with Kuchaikot P.S. Case No.330 of 2017.
