The petitioners seek bail in a case under Section 302 and other sections of the Indian Penal Code.
The informant, widow of the deceased, made
Patna High Court Cr.Misc. No.38343 of 2015 (2) dt.26-08-2015 2/2 allegation that some altercation took place on account of land dispute and on such all the 13 persons named in the FIR assaulted her husband with Khanti and other weapons.
It is submitted that no specific allegation is made against the petitioners. The deceased, Ganesh Tanti, got only one injury on his head and 13 persons are alleged to have assaulted. Similarly situated accused Bilash Mandal has already been enlarged on bail vide order passed in Cr. Misc. No. 10847 of 2015 and the case of the petitioners stands on the same footing. Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in Shambhuganj P.S.
