2. The petitioner apprehends his arrest in connection with Bathnaha P.S. Case No. 468 of 2023, registered for the offences punishable under Sections 323, 341, 307, 325, 354(B), 379, 509, 509/34 of the Indian Penal Code.

3. As per allegation, when the informant was going to attend the call of nature, the petitioner along with other accused persons, who were already waiting in ambush, pounced upon her. The petitioner started abusing her. On protest by the informant, co-accused Vikash Kumar pushed her and tried to commit misdeed with her. Thereafter, the petitioner gave an iron rod blow on her, causing injuries over her shoulder.

4. The learned counsel for the petitioner has submitted that he is innocent and has falsely been implicated in this case. There is case and counter case. The impugned order itself shows that the injury report was not produced which transpires that none has suffered any kind of injury.

5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st, Sitamarhi in connection with Bathnaha P.S. Case No. 468 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
