JUSTICE SUDHIR SINGH ORAL ORDER 12-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 394 and 302 of the Indian Penal Code and 27 of the Arms Act. As per prosecution case, while informant's brother was coming after collecting "Lakana", some miscreants looted Rs.50,000/- from him and fired shot upon him as a result of which he died on the spot.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 3.7.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Except confessional statement of the co-accused, there is no other material against the petitioner. Other co-accused has been granted bail vide Cr. Misc. no.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Sanjeev Kumar IV, Judicial Magistrate, Ist Class, East Champaran at Motihari in connection with Mehsi P.S. Case no. 100 of 2013.
