2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 126(2), 115, 85 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. Petitioner was married with sister of informant in 2009. Later on, petitioner and his family members started subjecting her to torture and harassment for non-fulfilment of demand of dowry of Rs. 3 lacs and on 23.1.2025 informant received information that his sister consumed poison and is in treatment in Lalganj Hospital. Victim died during treatment.

4. Learned counsel appearing for the petitioner, while denying the allegation, submits that the petitioner has falsely been implicated in this case because petitioner is husband of of the deceased. Petitioner had two children from the said wedlock. As a matter of fact, sister of informant was short tempered lady and she consumed poison due to trivial issue. FIR has been lodged for offence of abatement of suicide under section 108 of the BNS. Police after investigation submitted charge sheet for

Patna High Court CR. MISC. No.47766 of 2025(3) dt.12-09-2025 2/2 offence under sections 126(2), 115, 85, 82, 108 and 3(5) BNS. Petitioner is in custody since 10.2.2025.

5. Learned counsel for the State and informant oppose the prayer for bail.

6. Considering the nature of accusation and period of custody of the petitioner, his prayer for regular bail is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Vaishali at Hajipur in Bhagwanpur Police Station Case No. 27 of 2025.
