The petitioner is in custody in a case registered under Sections 379 and 411 of the Indian Penal Code. The allegation against the petitioner is that he along with another co-accused was caught by the mob with stolen motorcycle. They were also assaulted by the mob. On behalf of the petitioner, it has been submitted that the petitioner has got no criminal antecedent. He is in custody since 12.05.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. The petitioner has been made accused in this case due to mistake of fact. Other co-accused has been granted bail by a

Patna High Court Cr.Misc. No.39721 of 2015 (3) dt.13-10-2015 2/2 bench of this Court in Cr. Misc.No. 44174 of 2015. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in Ara Nawada P.S.Case No. 171/2015.
