2. The petitioner seeks bail in connection with Salaiya P.S. Case No. 75 of 2022 registered for the offence under Sections 302 and 34 of the Indian Penal Code.

3. As per the prosecution case, the F.I.R. was registered against unknown persons for killing the victim. The petitioner and others are suspected to have killed the deceased.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 22.08.2022 he is quite innocent and has not committed any offence.

5. He further submits that except for confessional statement of co-accused, no material has come against the petitioner during investigation. He further submits that similarly

Patna High Court CR. MISC. No.49888 of 2023(2) dt.19-08-2023 2/2 situated co-accused namely Dil Chand @ Dilchand Chaudhry (Vide Cr. Misc. No. 28518 of 2023) and Chhotu Bhuiyan (Vide Cr. Misc. No. 21280 of 2023) have been granted bail by coordinate Benches of this Court.

6. Learned A.P.P. has vehemently opposed the prayer for bail.

7. Considering the aforesaid facts, this application for regular bail is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-X, Aurangabad/concerned Court below in connection with S. Tr. No. 492/2022/512/2022 arising out of Salaiya P.S. Case No. 75 of 2022. (Sandeep Kumar, J) Shishir/- U T
