Petitioner, already in custody, seeks bail in connection with Kauakol P.S. Case No.137 of 2016, registered under Sections 341, 323, 307 and 304(B)/34 of the Indian Penal Code. Allegation in brief is that three years prior to the occurrence, the informant's daughter was married with the petitioner and on the alleged day of occurrence, the in-laws badly assaulted her daughter, after getting the information the informant reached there and found his daughter in injured condition, the deceased was taken to the local doctor but the doctor referred her to Nawada but on the way the daughter of the informant died.
Learned counsel for the petitioner submits that it was the
Patna High Court Cr.Misc. No.4267 of 2018(2) dt.01-02-2018 2/2 parents of the deceased who had taken her and they had killed the deceased.
Learned counsel for the State submits that the allegation is specific that the accused persons badly assaulted the deceased and due to multiple fractures of the rib and shoulder she died. Having considered the said facts and circumstances, the prayer of bail of the petitioner is rejected in connection with Kauakol P.S. Case No.137 of 2016, pending in the court of learned A.C.J.M.-IV, Nawada.
