2. The petitioner seeks regular bail in the present case registered for the offence under Sections 365, 366, 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is alleged to have kidnapped the victim girl.

4. Learned counsel for the petitioner submits that the victim girl in her statement recorded under Section 161 of the Cr.P.C. before the Police has submitted that she was in relationship with the petitioner and she has eloped with him. He further submits that petitioner is in jail since 03.04.2024.

5. Learned A.P.P. has vehemently opposed the prayer

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran/concerned Court below in connection with Raxaul (Haraiya O.P.) P.S. Case No. 59 of 2024 subject to condition that:- 7(i) The petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court through his lawyer or through himself.
