The petitioners seek bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 326, 307, 379, 427, 504 and 506 of the Indian Penal Code..
The prosecution case in short is that the accused persons, variously armed, assaulted the doctor of O.P.D. and other employees of the hospital.
It has been submitted on behalf of the petitioner that the petitioners are in custody since 12.6.2019 and have got no criminal antecedent. There is no allegation of tampering of
Patna High Court CR. MISC. No.51010 of 2019(3) dt.06-09-2019 2/2 witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The petitioners have falsely been implicated in the present case. General and omnibus allegation has been made against the petitioners. No specific overt act has been alleged against the petitioners.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 234 of 2016.
