The petitioner seeks bail in a case under Section 366A and other sections of the Indian Penal Code. The informant made allegation that the petitioner kidnapped his minor daughter. The victim made her statement under section 164 of the Cr. P.C. in which she disclosed that her husband was living outside. She voluntarily solemnized marriage with Ajit Sahani, the petitioner, in a temple in Hajipur. Ajit Sahani did not kidnap her.

Considering the facts aforesaid and the fact that the petitioner is in jail since 23.01.2015, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.38372 of 2015 (2) dt.26-08-2015 2/2 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Sikrahana at Motihari, East Champaran in Madhuban P.S. Case No. 05/2015.
