The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379, 504, and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he is residing separately from his brother and father for the last 12 years after taking his share in the property and is running a poultry-firm, it is next alleged that on 06.05.2021, the petitioner was uprooting the fencing of land of the informant's share and on objection it is alleged that the present occurrence took place in which petitioner's sisters

No.60407 of 2021(2) dt.13-07-2022 2/3 tore informant's cloths, petitioner gave repeated blow by a dabiya on his head, Rina Devi snatched Rs. 30,000/- from his pocket and Juhi Kumari snatched gold chain from his neck. Learned counsel for the petitioner submits that the informant has instituted the present case against his father, brother sister and brother-in-law, it is next submitted that only to create pressure for getting more property, the present false case has been instituted, it is next submitted that though it is alleged that the petitioner assaulted him on his head causing injury but the nature of injury is simple as would be evident from Annexure-2 to the anticipatory bail application. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
Considering the submissions made by the learned counsel for the petitioner and in the nature of allegation, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Madhuban P.S. Case No. 127 of 2021
