The petitioner is languishing in jail since 12.03.2015 in a case instituted under Sections 363, 302 and 201 of the Indian Penal Code.

As per allegation, it is a case of murder of the informant's son, namely, Chandan Kumar who is aged about seven years by the accused persons.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.03.2015. Petitioner has got no criminal antecedent. Chargesheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioner. Petitioner is not named in the FIR. The name of the

Patna High Court Cr.Misc. No.38325 of 2015 (3) dt.07-10-2015 petitioner has come in course of investigation. Merely on the basis of suspicion, there is no direct or indirect evidence against the petitioner nor there is any substantial evidence to suggest his implication in the present case.

On behalf of the State, it has been submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction learned ACJM, Dalsingsarai, Samastipur in connection with Dalsingsarai P.S.Case No.593 of 2014, G.R.No.1142 of 2014.
