Petitioner is not named in the first information report but in course of investigation, name of the petitioner surfaced in this case on the basis that some witnesses claimed to have seen the petitioner and co-accused Parsuram Singh standing near the place of occurrence and furthermore, informant and his family members claimed that prior to alleged occurrence petitioner used to visit the house of the deceased. Moreover, co-accused Parsuram Singh has already been granted privilege of bail by a coordinate bench of this court vide order dated 29.7.2015 passed in Cr. Misc. no.19936/2015. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Narpatganj P.S. Case no. 393/2014.
