JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 13-12-2023 Heard learned counsel for the petitioner as well as the learned APP for the State. Despite the notices having been received by the complainant herself, none appears on her behalf.
2. The petitioner apprehends his arrest in connection with Complaint Case No. 883 (C) of 2016, registered for the offences punishable under Section 498A of the IPC and Section 4 of Dowry Prohibition Act.
3. As per allegation, the marriage of the opposite party no. 2 with the petitioner was solemnized in the year 2016 and, he along with in-laws of the victim, started to torture her for non-fulfillment of demand of dowry and lastly, they ousted her from the matrimonial house.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, the complainant has already solemnized her re-marriage with one Sonu Chaudhary and she was blessed with three children out of her wedlock with Sonu Chaudhary.
5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Buxar in connection with Complaint Case No. 883 (C) of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
