The petitioner apprehends his arrest in Complaint Case No. 1447(C) of 2019, registered for the offences punishable under Sections 406, 420 and 34 of the Indian Penal Code.

Case of the complainant is that this petitioner cheated him of Rs. 11,35,261/-.

It is submitted that complainant is none else than business partner of the petitioner and due to some monetary dispute between the parties this case has been lodged. As matter of fact, complainant has to pay a sum of Rs. 2,58,000/- with interest of 15% per annum from the date of receipt of notice

Patna High Court CR. MISC. No.60191 of 2021(2) dt.30-06-2022 2/2 within 15 days along with items valued for Rs. 4,20,000/- to Beejak Seva Sansthan vide Annexure-5 to this petition. There is claim and counter claim going on between the complainant and Beejak Seva Sansthan & Ors. for transaction of money between the parties. The dispute is of purely civil in nature. No case under Section 420 IPC is made against the petitioner. Petitioner has not taken money with regard to claim under PMKVY to the Beejak Sevea Sansthan of which this petitioner was also one of the party. Petitioner claims clean antecedents.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in connection with Complaint Case No. 1447(C) of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
