JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. From perusal of the report of learned Additional Sessions Judge it is obvious that after commitment, no summons was ever served upon the petitioner and the petitioner was arrested on the strength of non-bailable warrant issued against him and furthermore, I find that petitioner is languishing in jail custody since 11.05.2015.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of

Patna High Court Cr.Misc. No.37582 of 2015 (3) dt.05-11-2015 2/2 Additional Sessions Judge-V, Danapur, Patna in connection with Sessions Trial No. 21 of 1995/Trial No. 824 of 2015 arising out of Maner P.S. Case No. 198 of 1991, subject to condition that he shall attend the trial court on each and every date in person for the period of one year or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any genuine cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
