JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-09-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307, 354(B), 379 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, this petitioner assaulted the informant with Farsa on his forehead and also disrobed his wife.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. There is case and counter case and case lodged by the petitioner is earlier in point of time. Petitioner is own brother of the informant.

Learned counsel appearing for the State opposes the

Patna High Court CR. MISC. No.59667 of 2021(4) dt.20-09-2022 2/2 prayer for anticipatory bail and submits that injury caused by the petitioner has been found to be grievous in nature. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
