JUSTICE SUDHIR SINGH ORAL ORDER 29-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code.
Allegation against the petitioner is that he along with other accused persons looted the bag containing mobile phone sets of the informant and also the mobile phone of the informant and one Ranjeet Kumar.
It has been submitted on behalf of the petitioner that he is in custody since 4.6.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the F.I.R. There is no recovery of incriminating articles from the possession of the petitioner. He has not been put on T.I.P. It is further submitted that petitioner may be released after completion of six months in custody from 4.6.2015.
On behalf of the State, it is submitted that petitioner's name has come on the confessional statement of the co-accused.
