The petitioner apprehends his arrest in connection with Rajauli P.S. Case No. 446 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Further he submits that from perusal of the seizure list, it appears that the recovery has been made from the bank of the river. Petitioner has no concern with the alleged recovery. It is also submitted that petitioner has no criminal antecedent.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

Patna High Court CR. MISC. No.59922 of 2021(2) dt.15-04-2022 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional District and Sessions Judge-II-cum-Special Judge, Nawada in connection with Rajauli P.S. Case No. 446 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
