The petitioners seek bail in Turkauliya (Banjariya) P.S. Case No. 457/2015, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The widow of the deceased Jahir Hussain made allegation against the petitioners and seven other persons and alleged that they all assaulted Jahir Hussain and Jahir Hussain died thereafter. It is submitted that omnibus and general allegation of assault is made against all the nine accused persons including the petitioners but from perusal of the post-mortem report it would appear that one bruise was found on left side of arm and another bruise was found on the left side of leg in front of knee. The doctor has opined the death due to shock on account of heart

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Turkauliya (Banjariay) P.S. Case No. 457/2015.
