2. The petitioner seeks bail in connection with Rajoun P.S. Case No. 147 of 2023 registered for the offence under Sections 379, 411 of the Indian Penal code and MMRD Act, 1957, under Section 4(1), 21 of Bihar Minerals Concession Prevention of Illegal Mining and Transportation and Storage Rules 56(2), 11, 41 Act, 2019.

3. As per the prosecution case, the petitioner is said to be involved in the illegal mining.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is in innocent and he is in custody since 4.3.2024.

5. Considering the aforesaid facts, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka / concerned Court below in connection with Rajoun P.S. Case No. 147 of 2023.

7. At the time of furning the bail bonds, the petitioner will give an undertaking in the Court below that he will stay outside Bihar and Jharkhand and he will provide the address where he will stay apart from Bihar and Jharkhand and if the petitioner files an affidavit providing the details of address where he will stay outside Bihar and Jharkhand, his bail bonds shall be accepted by the Court below. The petitioner will also mark his attendance at the local police station where he will stay and the Court below is also directed to verify that whether the petitioner is marking his attendance or not in the local police station of his stay and if the Court below finds that the petitioner is not marking his attendance at the local police station of his stay then the bail bonds of the petitioner shall be cancelled.
