Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409, 419, 420, 467, 468 and 34 of the IPC.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the FIR has been instituted alleging irregularities committed by Panchayat Rojgar Sewak, Mukhiya of Gram Panchayat and the Junior Engineer of Goradih Block, in implementation of MNREGA Scheme No. 1 to 5.

The learned counsel for the petitioner submits that petitioner, being Panchayat Sewak, has been falsely implicated in the instant case by the informant based on suspicion. It is next

No.49427 of 2025(2) dt.11-08-2025 2/2 submitted that Junior Engineer had approached this court seeking anticipatory bail by filing Criminal Miscellaneous No. 31911 of 2024 (Binay Kumar vs. the State of Bihar) and the same was allowed by learned Co-ordinate Bench by an order dated 23-5-2024.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Sabour P.S. Case No. 37 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.
