The petitioner seeks bail in a case registered for the offence under Section 394 of the Indian Penal Code. The prosecution case, as per F.I.R., is that the informant alongwith his brother after withdrawing the money from the Bank were returning home on motorcycle, on way, four miscreants riding on two motorcycles intercepted them and on the point of pistol, snatched cash and mobile phone from the informant and his brother and thereafter, also caused fire-arm injury to the informant.

It is submitted on behalf of petitioner that name of the petitioner has transpired during course of the investigation in the confessional statement of co-accused Izhar, who has already

Patna High Court CR. MISC. No.59077 of 2021(3) dt.28-03-2022 2/2 been granted bail by the court below itself (Annexure - 2). No looted article has been recovered from the possession of the petitioner and till date, he has not been put on T.I.Parade and he is in custody since 09.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Araria (Bairgachhi O.P) P.S.
