Petitioner, already in custody, seeks bail in connection with Sasaram (Town) P. S. Case No. 788 of 2017, registered under Sections 302/34 of the Indian Penal Code.
Allegation in brief is that the informant's wife was found killed in her house and the room was found locked. It is alleged that the petitioner was suspecting that deceased was having illicit relationship therefore, she was eliminated. Learned counsel for the petitioner submits that the petitioner is facing the trial and informant has not supported the case and is hostile.
Patna High Court Cr.Misc. No.3117 of 2018 (3) dt.07-03-2018 2/2 However, learned counsel for the State submits that the cause of death of the deceased was strangulation and she was killed in the room and door was locked and the petitioner is the husband of the deceased.
Having considered the said facts and circumstances, the prayer for bail of the petitioner stands rejected at this stage. The Trial Court is directed to expedite the trial and preferably conclude the same within a year, if, it is not concluded within stipulated time, the petitioner may renew his prayer for bail.
