The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Prosecution case, in short, is that the informant gave written report to the police on 06.12.2018 that his son Raviranjan @ Pappu Tiwari was shot dead by unknown criminals while he was sleeping in bathan in the night. It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.03.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. His name has come on confessional

Patna High Court CR. MISC. No.47826 of 2019(4) dt.27-09-2019 2/2 statement of co-accused. Except for this, there is no other substantive evidence to suggest the implication of the petitioner in the present case. There is no circumstantial evidence to suggest his implication in this case.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Daudnagar, Aurangabad in connection with Obra P.S. case No.263 of 2018.
