JUSTICE ARUN KUMAR ORAL ORDER 26-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 19.5.2017, seeks bail in Sahebganj PS Case No. 127 of 2017 registered under Sections 399, 402 of the IPC, Section 25(1-b)a, 26, 11 and 35 of the Arms Act and Sections 20 & 22 of the NDPS Act.

It is submitted that the petitioner was not apprehended on the spot; only his name was disclosed by Navin Kumar, co-accused, who too has been admitted to bail by a coordinate Bench of this Court by order dated 10.1.2018 in Cr. Misc. No. 569 of 2018 and the petitioner is in custody since 19.5.2017.

Having considered the said facts and circumstances, the petitioner, namely, Laddu Singh @ Laddu Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge -cum- Special Judge, Muzaffarpur in connection with Sahebganj PS Case No. 127 of 2017 on the following conditions:- (i) One of the bailors must be a close family member of the petitioner; and

Patna High Court Cr.Misc. No.17041 of 2018 (2) dt.26-03-2018 (ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
