JUSTICE SUDHIR SINGH ORAL ORDER 06-11-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302 and 120B/34 of the Indian Penal Code. Allegation against the petitioner is of killing husband of the informant.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 26.6.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. From perusal of paras- 7, 8, 9, 10 and 11 of the case diary it would appear that the deceased was in the habit of taking drink. The name of the petitioner has appeared merely on the basis of suspicion. There is no direct or indirect allegation against the petitioner. From perusal of the post mortem examination report it would appear that there is no external injury on the body of the deceased.

On behalf of the State, it is submitted that the petitioner is

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of Sri Rajesh Pandey, Judicial Magistrate, Ist Class, Vaishali at Hajipur in connection with Desari P.S. Case no. 9 of 2015.
