JUSTICE PARTHA SARTHY ORAL ORDER 25-03-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Kasim Bazar P.S. Case no. 270 of 2020 (G.R. no.1798 of 2020) registered under sections 366(A) and 34 of the Indian Penal Code. As per allegation in the F.I.R., it is stated by the informant that his minor daughter disappeared and subsequently it transpired that she was with the petitioner. It is submitted by learned counsel for the petitioner that the daughter of the informant returned home and her statement was recorded under section 164 Cr.P.C. which has been brought on record as Annexure-2 to the petition. Patna High Court CR. MISC. No.5256 of 2021(2) dt.25-03-2021 2/2 same it would transpire that she had gone out of her own volition. The petitioner is in custody since 2.10.2020, charge sheet has been submitted in the case and he has no criminal antecedent.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the contents of the statement under section 164 Cr.P.C. together with the investigation in the case having concluded, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Kasim Bazar P.S. Case no. 270 of 2020 (G.R. no.1798 of 2020) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Munger.
