JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-09-2018 The petitioner being a senior citizen has challenged the order dated 25.06.2016, passed by Respondent No.3, the S.D.O.-cum-Chairman, Patna Sadar, as contained in Annexure1, whereby the tribunal has rejected the claim of the petitioner for ejectment of his two sons under the Maintenance and Welfare of Parents and Senior Citizen Act, 2007 (hereinafter referred to as 'the Act').
After some argument, learned counsel for the petitioner seeks permission to withdraw the present writ application with a liberty to file an appeal under the Act.
Patna High Court CWJC No.2812 of 2017(2) dt.17-09-2018 2/2 In view of the beneficial legislation in favour of senior citizen and the prayer of the petitioner, this Court permits the petitioner to prefer an appeal within a period of three weeks from the date of receipt/production of a copy of this order along with an application for condonation of delay, and the same may be considered by the appellate Court in view of the fact that the writ application was pending before this Court.
