The petitioner is in custody in connection with Phulwarisharif P.S. Case No. 133 of 2016 arising out of S. Tr. No. 688 of 2016, a case under Sections 399, 402 and 414 of the Indian Penal Code and Section 25 (1-b)A/26/35 of the Arms Act. A country made loaded pistol was recovered from the possession of the petitioner though it was wrongly recorded as two country made revolvers in the order dated 01.05.2017 passed in Cri. Misc. No. 20278 of 2017.
The petitioner is in custody since 4th of March, 2016. Earlier prayer was refused with a direction to learned trial judge to conclude the trial within nine months vide
Patna High Court Cr.Misc. No.6023 of 2018 (3) dt.07-03-2018 2/2 Annexure-I.
The report of the trial judge would reveal that trial has not been concluded as yet.
Considering the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Phulwarisharif Police Station Case No. 133 of 2016 arising out of S. Tr. No. 688 of 2016 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
