The petitioner seeks bail in Sessions Trial No. 21 of 2019 arising out of Birpur (Balua Bazar) P.S. Case No. 112 of 2018, instituted for the offence under Section(s) 147, 148, 149, 341, 323, 324, 325, 307, 379, 302, 504 and 506 of the Indian Penal Code pending in the court of learned District and Sessions Judge, Supaul.
Prayer for bail of the petitioner was earlier rejected by this Court vide order dated 2.11.2018 passed in Cr. Misc. 55275 of 2018.
As per written report petitioner is main assailant in the case.
Report from the court below regarding stage of the
Patna High Court CR. MISC. No.45729 of 2019(4) dt.21-08-2019 2/2 case is received. From the report it appears that out of eleven witnesses, seven have already been examined. The court below has mentioned in the report that trial is likely to be concluded within three months.
Therefore, this Court is not inclined to grant bail to the petitioner at this stage.
Prayer for bail of the petitioner stands rejected. Counsel for the petitioner submits that petitioner is in custody since 24.11.2017.
The trial court is directed to conclude the trial as early as possible and make efforts to conclude the trial within a period of six months from the date of receipt/production of copy of this order by either fixing the case on day-to-day basis or by giving short adjournment in the case and send compliance report to this Court.
