JUSTICE PARTHA SARTHY ORAL ORDER 24-03-2021 Heard learned counsel for the petitioner and learned APP for the State, through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Minapur P.S. Case no. 113 of 2019 registered under sections 272 and 273 of the Indian Penal Code and sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act.

As per allegation in the FIR, on a raid being conducted 52.5 litres of IMFL was recovered from the agricultural land of one Arun Singh and on enquiry it transpired that the same belong to the petitioner and one another. It is submitted by learned counsel for the petitioner that no recovery has taken place from the person or possession of the petitioner. He is in custody since 19.10.2020 and has no

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the FIR together with the period in custody, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Minapur P.S. Case no. 113 of 2019 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
