1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Babarganj P.S. Case no.49 of 2025 registered under sections 126(2), 127(2), 115(2), 109, 190, 191(2) and 191(3) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.
3. As per the prosecution case, the informant states that the four named accused persons including the petitioner herein as also Rakesh Chowdhary and two unknown accused persons are said to have assaulted the informant, snatched his mobile phone and resorted to firing. No person sustained any firearm injury.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The
Patna High Court CR. MISC. No.47580 of 2026(2) dt.22-07-2026 2/2 allegations are general and omnibus in nature. He is in custody since 26.2.2026 and co-accused Rakesh Chowdhary has been enlarged on bail vide order dated 13.1.2026 passed in Cr. Misc. no.80700 of 2025.
5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR, the petitioner having remained in custody since 26.2.2026 and specially grant of bail to co-accused Rakesh Chowdhary vide aforesaid order 13.1.2026, the Court directs the petitioner to be enlarged on bail in connection with Babarganj P.S. Case no.49 of 2025 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J 3rd, Bhagalpur.
