The petitioner has preferred the present writ application, being aggrieved with non-grant of benefits under the Indira Aawas Scheme. However, learned counsel for the petitioner has drawn attention of this Court to the order dated 05.05.2017, passed in Case No.51321-00907, by the S.D.O.- cum- Sub-Divisional Public Grievance Redressal Authority, Benipur, Darbhanga, whereby, the petitioner's complaint has been rejected.

However, after some arguments, learned counsel for the petitioner seeks permission to withdraw the present writ

Patna High Court CWJC No.13075 of 2017(2) dt.01-10-2018 2/2 application to prefer appeal before appropriate forum, under the Bihar Right to Public Grievance Redressal Act, 2015. Permission is accorded.

Accordingly, the present writ application is disposed of as withdrawn with above-mentioned liberty to the petitioner. If such appeal is filed within a period of three weeks along with an application for condonation of delay in filing of appeal, it is expected from the Appellate Authority to look into the matter and to dispose of the said appeal on merits within a period of six weeks of its filing, in accordance with law, keeping in view of the fact that the petitioner is pursing his remedy before this Court.
