JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-04-2018 Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 21.11.2017 passed in Cr. Misc. No.21.11.2017.

Submission of the learned counsel for the petitioner is that there was contradiction between the statement of the victim girl recorded under Section 164 Cr.P.c. and in her statement recorded under Section 164 Cr.P.C. further alleged that the girl was major and the petitioner is in custody since 10.8.2017. Heard learned A.P.P. also.

Having heard both sides and perused the report, from which it appears that the charge has been framed and the learned trial court has sought eight months further time. Considering the fact, I am not inclined to grant bail to

Patna High Court Cr.Misc. No.18642 of 2018 (3) dt.19-04-2018 2/2 the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of six months by conducting it on regular basis.

At the same time, the S.P., Gaya is also directed to ensure presence of the witnesses on each and every date so that the trial may be conclude within the period as specified. With the aforesaid observation, this application is dismissed.
