The petitioners seek bail in a case registered for the offences punishable under sections 304-B/34 of the Indian Penal Code.
The informant alleged that on 31.01.2014 she got an information that her daughter Sanjana Devi has been killed by her husband and other in-laws for non fulfillment of dowry demand. The deceased was married to Dilip Manjhi five years ago.
It has been submitted on behalf of the petitioners that they are in custody since 12.12.2014. Charge-sheet has been submitted in the case. Petitioners have got no criminal antecedent.
Patna High Court Cr.Misc. No.41261 of 2015 (3) dt.14-10-2015 There is no allegation of tampering with the evidence against the petitioners. Petitioner no. 1 is father-in-law and petitioner no. 2 is mother-in-law of the deceased. Petitioners are separate in mess and property from the husband of the deceased. Petitioners have falsely been implicated in the present case.
On behalf of the State, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Rosera, Samastipur in connection with Singhia P.S. Case No. 18 of 2014, G.R. No. 106 of 2014.
