The petitioner seeks bail in a case registered under Sections 376, 323, 379, 504, 506 of the Indian Penal Code and Sections 4/6 of POCSO Act.
Allegation is that the petitioner established physical relation with the daughter of the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 3.1.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The allegations made by the victim does not find support from the medical report. The victim has already been examined in course of trial. Her deposition is Annexure 3
Patna High Court CR. MISC. No.46212 of 2019(2) dt.30-07-2019 2/2 to the present application, where she has admitted that she has got married with the petitioner and she wants to reside with the petitioner.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st, Supaul in connection with POCSO case No.13 of 2018 arising out of Mahila P.S. case No.39 of 2018.
