Mr.Yogendra Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 30-07-2025 Heard Mr. Ranjeet Kumar Singh, learned counsel appearing on behalf of the petitioners and Mr. Yogendra Kumar, learned APP for the State.

2. The petitioners seek pre-arrest bail in connection with Sahebpur Kamal P.S. Case No. 93 of 2025 registered for the offence(s) punishable under Sections 191(2), 112(2), 117(2), 118(2), 352, 351(1)(2) and 109(1) of the BNS.

3. As per the allegation made in the FIR, the accused persons named therein including the petitioners have assaulted the informant and his father, as a result of which, they sustained grievous injuries.

4. Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.46879 of 2025(2) dt.30-07-2025 2/3 petitioners submitted that petitioners are innocent. Both the parties and Gotia and there is admitted land dispute between them. The allegation is ornamental and no specific allegation has been levelled against these petitioners that they were the persons, who have assaulted and committed crime. Petitioners have clean antecedents. On these grounds, petitioners seeks to be released on pre-arrest bail.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Having considered the rival submissions made on behalf of the parties, as well as, the allegation made in the FIR, I find that general and omnibus allegation has been alleged against the petitioner no.1 and as such, the petitioner no.1, above named, is directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM IV, Begusarai in connection with Sahebpur Kamal P.S. Case No. 93 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.

7. So far as petitioners no.2 and 3 are concerned, there

The informant is the eyewitness and he has alleged that they in a planned manner to kill him had brutally assaulted and could be saved only when his father came to his rescue, though he has also been assaulted. I am not inclined to grant pre-arrest bail to the petitioners no.2 and 3.
