ANJANA PRAKASH ORAL JUDGMENT Date: 24-11-2015 Heard learned counsel for the Petitioners and the State. It has been submitted that the Petitioner No. 2 is dead and, therefore, the application as against him is dismissed as withdrawn.
As for Petitioner No. 1, the Petitioner seeks revision of the Judgment of conviction dated 31.3.2006 passed by the Additional Sessions Judge, F.T.C. 3, Sheohar at Sitamarhi, in Criminal Appeal No. 47 of 2003/4 of 2005 by which he has affirmed the order of conviction dated 13.11.2003 passed by the Sub Divisional Judicial Magistrate, Sheohar at Sitamarhi, in connection with G.R. No. 331 of 1999, Trial No. 119 of 2003 arising out of Tariyani P.S. Case No. 91 of 1999.
Patna High Court CR. REV. No.422 of 2006 dt.24-11-2015 2/2 Having gone through the Judgment of conviction dated 31.3.2006, passed by the Additional Sessions Judge, F.T.C. 3, Sheohar at Sitamarhi, in Criminal Appeal No. 47 of 2003/4 of 2005, I do not find any reason for interference.
Hence, the application against the Petitioner No. 1 stands dismissed.
However, considering the period of custody undergone by the Petitioner No. 1 , the sentence is modified to one already undergone by him.
