Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 8(c), 21(c), 22(c), 23, 24, 25, 27(A) and 29 of the N.D.P.S. Act and Section 30(a) of the Bihar Prohibition and Excise Act.

Cough syrup containing codeine was recovered from a truck.

Submission is that the petitioner was simply a carrier with all the papers of consignment of the syrup from proper and identified consigner to be carried to known consignee. Petitioner has got no criminal antecedent.

Considering the fact that the syrup was in sealed

No.5410 of 2021(2) dt.13-04-2021 2/2 cartons and the petitioner was simply a carrier, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with N.D.P.S. Case No. 15 of 2020 arising out of Singheshwar P.S. Case No. 228 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
