Petitioner, already in custody, seeks bail in connection with Bhagwanpur Hat P.S. Case No.154 of 2015, giving rise to Sessions Trial No.180 of 2016 + 387 of 2016, registered under Sections 324, 307 and 302 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that the petitioner shot on the chest of the informant resulting into his death.

Learned counsel for the petitioner submits that petitioner is in custody since 27.05.2016 and two witnesses have been examined out of nine whereas the learned counsel for the State as well as the informant submit that petitioner is the sole accused having specific allegation of killing the informant by

Patna High Court Cr.Misc. No.16498 of 2018(3) dt.26-03-2018 2/2 shooting on his chest and witnesses are being examined. Having considered the aforesaid facts and circumstances and the specific accusation as well as the nature of offence, the prayer of bail of the petitioner is rejected in connection with Bhagwanpur Hat P.S. Case No.154 of 2015, giving rise to Sessions Trial No.180 of 2016 + 387 of 2016, pending in the court of learned Additional District Judge-IV, Siwan with a direction to the trial court to expedite the trial.
