JUSTICE SATYAVRAT VERMA ORAL ORDER 09-03-2022 Heard learned counsel for the petitioners and Mr. Surendra Prasad Singh, learned A.P.P. for the State. The petitioners seek bail in connection with Suiya P.S. Case No. 51 of 2021 instituted for the offences under Sections 25(1-B)A/26/35 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are in custody since 06.07.2021 is a person with clean antecedent, charge-sheet has been submitted in the case and the allegation is of recovery of countrymade pistol from Ganesh Turi (Petitioner No. 1) and petitioner no. 2 was found sitting with him as pillion on a motorcycle. Learned counsel for the petitioners submits that the

No.59007 of 2021(2) dt.09-03-2022 2/2 petitioners have falsely been implicated in the case and even presuming what has been alleged is true, without admitting, then allegation is of recovery of a countrymade pistol only and as far as petitioner no. 2 is concerned, nothing was recovered from his possession.

Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.

Considering the fact that the petitioners are in custody since 06.07.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM -1st, Banka in connection with Suiya P.S.
